Terms and Payment:
All prices are F.O.B. our plantation at Hornell, New York. All payments must be pre paid: either by cash, check, cashiers check, or credit card depending on previous written arrangements. All invoices over 30 days are charged a 15% monthly surcharge on unpaid balances. Any and all legal action needed to rectify any unpaid balances are to be held in Steuben County, NY (said origin of trees). Any and all legal fees are to be reimbursed by outstanding customer. All accounts regardless of terms must be settled in full by the following date:
Fall 2016 business by December 20th, 2016
Spring 2017 business by July 1st, 2017
Shipping:
Arrangements for trucking may be made by yourself providing that such trucks arrive during L.R. Stutzman’s & Sons, LLC. loading hours. All trucks must be equipped with the necessary tarps & ropes to secure and protect Evergreens during transit.
Customers picking up plant material must bring suitable horticulture covering and strapping (ropes, etc.) to protect and secure plants during transport. Loading hours are 8:00 AM to 3:00 PM Monday through Friday.
We cannot be held responsible for delay in shipping due to weather or conditions beyond our control. Unloading of trucks is the responsibility of the customer.
Guarantees:
Due to the conditions beyond our control, including but not limited to delay or poor handling in transit; improper tarping material, improper care before and during planting, drought, fertilizer and herbicide damage after planting, we cannot and will not guarantee survival of plant material. We do everything possible at the nursery to ensure survival of all plant material. Our Liability ceases when trees are loaded onto carrier. All concerns with plant material must be faxed to our home offices within 5 business days.
Inspection:
All stock has been inspected by the New York State Department of Agriculture and Markets and found to be apparently free from insects and disease. New York State Inspection Certificate No. 462739.
Tagging:
We continue to encourage each customer to visit our plantation and tag their own nursery stock. We can at Your Request and Your Accountability Tag Your Order. We adhere to the “American standard for nursery stock.”
